Avery Aircraft Acquisitions Contact Request Terms and Conditions

By submitting a contact request to Avery Aircraft Acquisitions, the submitting party acknowledges that the inquiry is made for the genuine purpose of pursuing an aircraft acquisition transaction and not for solicitation, data harvesting, market fishing, disruption, or any other non-serious purpose.

Buyer Acknowledgement
By submitting this contact request, the undersigned affirms that:The inquiry is being made as a serious prospective buyer, buyer representative, principal, or duly authorized intermediary with a legitimate interest in acquiring an aircraft. The submitting party understands that aircraft transactions are documentation-intensive and time-sensitive, and that Avery Aircraft Acquisitions may rely on the accuracy of the information provided in evaluating whether to proceed. The submitting party is prepared to participate in a professional acquisition process that commonly includes a Letter of Intent (LOI), proof of funds, buyer identity verification, and escrow coordination.

Required Documentation
As a condition of moving forward beyond an initial inquiry, the submitting party acknowledges a present intention and willingness to promptly provide, upon request and in form reasonably acceptable to Avery Aircraft Acquisitions, the following:

  • A signed Letter of Intent (LOI) setting forth the principal transaction terms, as commonly used to outline the basic structure of an aircraft purchase.
  • Proof of Funds (POF) sufficient to demonstrate financial capacity to complete the contemplated acquisition and support source-of-funds review where applicable.
  • Know Your Customer (KYC) documentation, including buyer identification, entity formation records, beneficial ownership information, and related compliance materials as reasonably requested.Any additional buyer, corporate, banking, escrow, legal, or compliance documentation reasonably necessary to verify seriousness, authority, identity, and transactional capability.

Escrow Deposit Acknowledgement
The submitting party understands and agrees that, if the transaction advances to an accepted stage designated by Avery Aircraft Acquisitions, a deposit equal to 20% of the agreed acquisition amount may be required to be placed with a mutually acceptable escrow agent in order to secure the aircraft and proceed toward definitive documentation and closing. Industry materials commonly discuss escrow deposits in aircraft transactions as evidence of commitment, although deposit structure, timing, refundability, and escrow instructions are governed by the specific LOI, purchase agreement, and escrow arrangements for the transaction.Submission of a contact request does not itself create a binding purchase agreement, reserve any aircraft, obligate Avery Aircraft Acquisitions to present an opportunity, or guarantee that any aircraft will be held pending receipt of documentation or funds.

Screening and Anti-Spam Policy
Avery Aircraft Acquisitions reserves the right, in its sole discretion, to ignore, reject, defer, or discontinue communications where an inquiry appears incomplete, unverifiable, abusive, speculative, deceptive, automated, promotional, non-serious, or inconsistent with a legitimate aircraft acquisition effort.Without limitation, Avery Aircraft Acquisitions may decline to proceed where:The submitting party refuses or delays providing requested identity, authority, financial capability, or compliance documentation. The inquiry appears to be a broker-fishing effort, unauthorized listing inquiry, data-collection exercise, or other transaction without a real and present buying mandate. The submitting party provides false, misleading, incomplete, or unverifiable information. The submitting party is unwilling to participate in escrow, contractual documentation, or reasonable diligence procedures customary for aircraft transactions.

No Advisory or Fiduciary Relationship
Submission of a contact request does not create an agency, fiduciary, legal, tax, brokerage, or advisory relationship unless and until expressly established in a separate written agreement executed by Avery Aircraft Acquisitions.

Accuracy and Authority
The submitting party represents that all information provided in the contact request is true, correct, and complete to the best of its knowledge and that the individual submitting the request has authority to submit the inquiry on behalf of the prospective buyer or represented entity.

Confidential Evaluation
Any information submitted may be reviewed for the purpose of evaluating buyer legitimacy, transaction readiness, compliance considerations, and fit for available acquisition opportunities. Avery Aircraft Acquisitions may request supplemental information before responding substantively or releasing transaction-sensitive details.

No Commitment Until Definitive Agreement
Any transaction remains subject to further review, seller approval, aircraft availability, due diligence, negotiation of definitive agreements, escrow instructions, and satisfaction of all legal, compliance, and closing requirements. LOIs in aircraft transactions commonly address core terms and escrow mechanics, but the final rights and obligations of the parties are determined by the executed purchase and sale documentation and related escrow instructions.

Consent Statement
By submitting a contact request, the submitting party confirms that it has read and agrees to these Terms and Conditions and understands that Avery Aircraft Acquisitions will treat the submission as a representation of serious buyer intent.
